Terms of Service
Effective August 6, 2026
Be kind, share only what you have the right to share, verify plant and AI information yourself, and remember that cutting arrangements are made directly between members.
1. Agreement and operator
These Terms of Service (“Terms”) are an agreement between you and Dennis Yang, operating Plant Parenthood in California, United States (“Plant Parenthood,” “we,” “us,” or “our”). They apply to the Plant Parenthood iOS app, website, API, and related services (together, the “Service”).
By creating an account, signing in, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 to use the Service. If you are not old enough to enter a binding agreement where you live, you may use it only with permission from a parent or legal guardian who agrees to these Terms. You may not use the Service if applicable law prohibits you from doing so.
3. Accounts
Provide accurate information, keep access to your email account and device secure, and promptly tell us if you suspect unauthorized access. You are responsible for activity through your account. Do not impersonate another person, create an account for someone without permission, sell or transfer an account, or use the Service to evade a restriction.
4. Your content and the permission you give us
You keep ownership of content you submit, including photos, captions, profile and plant information, care notes, comments, cutting-request information, and plant-family claims (“User Content”). You must have the rights and permissions needed to submit it and must not violate another person’s intellectual-property, privacy, publicity, or other rights.
You grant Plant Parenthood a nonexclusive, worldwide, royalty-free license to host, store, cache, reproduce, resize, technically modify, display, and distribute your User Content only as needed to operate, secure, maintain, and improve the Service. This license includes allowing our service providers to process the content for those purposes. It ends when the content is deleted from our active systems, except for copies reasonably retained in backups, logs, legal records, caches, or by other members who received public or shared content.
Some User Content is shared with signed-in members, and image URLs are public by link. Cutting-request details are intended only for the participating members. Review the Privacy Policy before posting or sharing contact information.
5. Community rules
Treat other plant parents with care. You may not use the Service to:
- harass, threaten, stalk, exploit, or discriminate against anyone, or post hateful, sexually explicit, pornographic, exploitative, or violent content;
- impersonate others, commit fraud, spam, manipulate engagement, or make materially misleading plant, ownership, provenance, or exchange claims;
- post private or sensitive information about another person without permission;
- infringe intellectual-property or privacy rights, distribute malware, interfere with the Service, bypass security or usage limits, or scrape or automate access without written permission;
- offer, request, possess, ship, or distribute anything illegal, regulated without required authorization, invasive, protected, stolen, diseased, pest-infested, or unsafe; or
- encourage anyone to violate law or these Terms.
We may review reports, remove content, limit features, or suspend accounts, but we are not obligated to pre-screen every post or exchange. Report concerns to support@plantparenthood.cc.
6. Cuttings exchange
Plant Parenthood helps members request and coordinate plant cuttings for gifts and trades. Sales are not supported. The Service currently does not provide checkout, payments, escrow, shipping labels, insurance, inspection, fulfillment, refunds, or transaction protection. Any permitted gift, trade, pickup, shipment, shipping cost, or other arrangement is solely between the participating members.
Plant Parenthood is not the buyer, seller, donor, recipient, broker, carrier, payment processor, marketplace transaction party, insurer, or guarantor. We do not verify a member’s identity or guarantee that a cutting is authentic, correctly identified, healthy, viable, pest-free, lawful, safe, delivered, or suitable for a particular use.
You are responsible for deciding whether and how to proceed, protecting your privacy, arranging safe meetings or shipping, inspecting and isolating plant material, resolving disputes, and paying any agreed shipping costs. Use a safe public place for in-person handoffs and do not share more personal information than necessary.
7. Plant, pest, and shipping laws
Plants, cuttings, seeds, soil, pests, invasive species, protected species, and nursery stock may be restricted by federal, state, local, tribal, or international rules. Before offering, requesting, carrying, or shipping plant material, you must check and follow all applicable quarantine, phytosanitary, import, export, carrier, permit, labeling, and agricultural requirements. Do not use Plant Parenthood to avoid those rules. You assume the biological, legal, shipping, and in-person risks of any arrangement.
8. Plant families
Plant-family links are member-submitted provenance records, not scientific verification. Only link plants of the same type and submit parent-child information you reasonably believe is accurate. A link across owners requires the other owner’s confirmation, and either owner may later unlink it. We do not guarantee the accuracy, permanence, or availability of a family graph.
9. AI and plant information
Plant identification, photo matching, confidence scores, care suggestions, and other automated or community information are estimates and may be incomplete or wrong. They are for general information only and are not professional horticultural, agricultural, toxicology, medical, veterinary, legal, import, or safety advice.
Independently verify important information before eating or handling a plant, exposing children or animals, treating disease or pests, using chemicals, or transporting or shipping plant material. For a possible poisoning or emergency, contact local emergency services or an appropriate poison-control or veterinary professional.
10. Our service and intellectual property
Subject to these Terms, we give you a personal, limited, nonexclusive, nontransferable, revocable license to use the Service. Plant Parenthood and its licensors own the Service, software, design, and branding, excluding User Content. You may not copy, sell, sublicense, reverse engineer except where law permits, interfere with, or create derivative services from the Service without permission.
If you send feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use it without restriction or compensation, without identifying you publicly unless you agree.
11. Apple and third-party services
If you downloaded the app from Apple, Apple’s Standard Licensed Application End User License Agreement applies to the app license in addition to these Terms. Apple is not responsible for the Service, User Content, support, or cutting arrangements.
The Service relies on or links to third-party services. Their separate terms and policies may apply. We are not responsible for third-party services, content, availability, or actions.
12. Suspension, termination, and service changes
You may stop using the Service or delete your account at any time. We may remove content or restrict, suspend, or terminate access when we reasonably believe there is a Terms violation, abuse, fraud, safety or legal risk, security problem, prolonged inactivity, or need to protect the Service or others. We may change or discontinue features and do not guarantee that the Service or any content will always be available.
After termination, provisions that by their nature should survive will remain in effect, including ownership, licenses for retained copies, disclaimers, liability limits, indemnity, and dispute terms.
13. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” PLANT PARENTHOOD DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR SECURE OPERATION; CONTENT PRESERVATION; AI OR PLANT INFORMATION; MEMBER IDENTITY OR CONDUCT; OR THE QUALITY, HEALTH, LEGALITY, SAFETY, DELIVERY, OR OUTCOME OF ANY CUTTING ARRANGEMENT.
Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you. Nothing in these Terms limits a warranty or consumer right that cannot lawfully be limited.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLANT PARENTHOOD AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM THE SERVICE, USER CONTENT, OTHER MEMBERS, AI RESULTS, PLANTS, PESTS, MEETUPS, SHIPPING, OR EXCHANGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID PLANT PARENTHOOD FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM OR US$100. These limits apply regardless of the theory of liability but do not limit liability that cannot lawfully be excluded or limited.
15. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Plant Parenthood and its service providers from third-party claims, losses, and reasonable costs arising from your User Content, your conduct, your cutting arrangements, or your violation of these Terms or law. This does not require you to indemnify anyone for their own unlawful conduct or where applicable law does not permit it.
16. Governing law and disputes
California law governs these Terms, without regard to conflict-of-law rules, except where the law where you live gives you nonwaivable consumer protections. Before filing a claim, you and Plant Parenthood agree to try in good faith for 30 days to resolve it by emailing a written description to the other party. If it is not resolved, claims may be brought in a court with jurisdiction in California, unless applicable law allows or requires another forum. Either party may seek urgent injunctive relief without waiting 30 days.
These Terms do not require arbitration and do not waive a right to participate in a class action where that right otherwise applies.
17. General terms
These Terms and the Privacy Policy are the entire agreement about the Service, except for terms that expressly apply from Apple or another third party. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our permission; we may assign them as part of a reorganization or transfer of the Service.
We may update these Terms as the Service changes. We will post the new effective date and provide additional notice when a change is material and applicable law requires it. Continuing to use the Service after updated Terms take effect means you accept them.
